Service Contract

The following Service Contract (“Contract”) constitutes the agreement between you (“Client”) and SESTIGE SOLUTIONS, P.O. Box 165, Kenilworth, NJ 07033 with contact numbers: 1-888-835-2433 (1-888-TEK-AIDE) regarding TekAide Services as defined herein.

SESTIGE SOLUTIONS’ TekAide Services include Remote Computer Support Services for residential and small business locations as described in this Contract and at the SESTIGE SOLUTIONS Web site: www.sestige.com.

1. SCOPE OF SERVICES

SESTIGE SOLUTIONS’ TekAide Services involve remote computer support services for PCs and Apple computers, rendered at your residential or small business locations. The scope of these services include:

    1. Installation and network services
    2. Troubleshooting and repair services (labor only or parts and labor)
    3. Optimisation and upgrade services
2. SERVICE COVERAGE

SESTIGE SOLUTIONS’ TekAide Services are provided in specific areas in New Jersey, and can be availed of by contacting SESTIGE SOLUTIONS Customer Support at 1-888-835-2433. For services rendered outside the specified areas in New Jersey, additional charges for travel may be applied. SESTIGE SOLUTIONS reserves the right to change areas of coverage at its discretion, and reserves the right to deny service without liability or penalty, except as expressly stated in this Contract.

3. SERVICE AVAILABILITY AND APPOINTMENTS

SESTIGE SOLUTIONS’ TekAide Services are regularly available 7 days a week from

8:00 am to 5:00 pm Eastern Standard Time. Standard on-site services are available for next day appointments, whenever possible, if made before 3:00 pm the previous day. Additional charges may apply for rapid response services or services rendered outside the regular service hours. Appointment cancellations or rescheduling must be received at least 24 hours before the scheduled service call; otherwise, a cancellation fee equivalent to one hour of labor will be charged. Appointment changes will be subject to availability of the next open service slot. A diagnosis toll-free call to SESTIGE SOLUTIONS at 1-888-825-2433 is required to schedule an appointment. The diagnosis call will determine if steps (such as purchasing or installing cables, furniture, accessories, etc.) need to be taken by the Client prior to the service appointment.

4. SERVICE DURATION

SESTIGE SOLUTIONS’ TekAide Services are limited to one trip per service call, for a total duration of two hours per call. If multiple trips and extended hours are required, additional charges will be applied.

5. ADDITIONAL CHARGES FOR LABOR AND PARTS

Should additional labor and/or parts be required in the performance of the TekAide services and remedies, technicians will provide an estimate of the additional labor charges and/or cost of additional parts. You will be given the option to proceed at your convenience or to consider the service complete. Service charges for labor and parts already rendered or installed will be applied. Should you decide to avail of the additional labor and parts at another time, a new service call will be scheduled and billed separately.

6. SERVICE LOCATION ACCESS AND REQUIREMENTS

In order to perform the required services, TekAide technicians must have your consent to enter the residence or office area and have access to the computers, peripherals, equipment, and media relevant to the service. The area to be serviced must be a safe working environment, and electrical power must be available. Should any of these requirements be unavailable at the appointed service call, TekAide technicians can deny service and impose cancellation charges.

7. SERVICE LOCATION PREPARATIONS

In the performance of TekAide services, technicians will not move or install furniture, alter or install electrical outlets, wiring and cabling, or handle any of your personal property outside the scope of the service. All electrical and furniture arrangements and set-ups must have been performed before the TekAide technicians arrive at the premises. Service delays due to the location not being ready for the service call will result in additional charges. TekAide technicians will not be responsible for injury or damage caused by the failure or breakdown of elements you have provided, such as faulty electrical, mounting equipment, or furniture.

8. THIRD PARTY SERVICES

SESTIGE SOLUTIONS reserves the right to provide TekAide services through authorized third party or independent service technicians and representatives.

9. FORCE MAJEURE

Should TekAide technicians be hindered or impaired from performing the appointed service due to circumstances control, including but not limited to weather, traffic and road conditions, natural disasters, strikes, and other force majeure circumstances, SESTIGE SOLUTIONS may choose to cancel the service and consult with you for a reschedule of the service appointment.

10. LABOR GUARANTEE

SESTIGE SOLUTIONS provides a 45-day labor guarantee for all services rendered by TekAide technicians. The guarantee is provided to you as the original client and to the work provided at the original service call. Should the original work be altered by system software or computer hardware modifications and upgrades, the guarantee will become null and void.

11. PARTS GUARANTEE

SESTIGE SOLUTIONS provides a 90-day parts guarantee for all parts replaced by TekAide technicians limited to the following: memory chips, heat sinks, power supplies, power switches, media card readers, modems, CD/DVD drives, and fans. SESTIGE SOLUTIONS reserves the right to use generic replacement parts, which may be new or refurbished. All removed parts become the property of SESTIGE SOLUTIONS. The replacement parts guarantee is reckoned from the date of installation, is non-transferrable, and explicitly covers only the part installed at the time of service. Abuse or misuse of the replacement part renders the guarantee null and void.

12. CLIENT RESPONSIBILITIES

For the performance of on-site TekAide services, the following terms must apply:

    1. High speed Internet access must be available for the performance of service that requires access to the World Wide Web.
    2. Computers, peripherals, equipment, accessories, and drivers must be compatible.
    3. All essential programs, applications, files, and data must have been backed up beforehand. TekAide technicians can perform backups but unless the task is specifically indicated in the service call, additional charges may apply. TekAide technicians will not be responsible for lost or corrupted programs, applications, files, and data if proper backup procedures have not been performed prior to the service call. TekAide technicians reserve the right to decline service if proper backup procedures have not been performed prior to the service call.
    4. Only owner-licensed programs, applications, drivers, utilities, and devices will be repaired, installed, or reinstalled by TekAide technicians.
    5. TekAide technicians perform services involving data recovery and remedies from virus and malware infections, but Client must subscribe to adequate and updated protection to prevent re-contamination.
SESTIGE SOLUTIONS reserves the right to refuse service if Client responsibilities are applied.

13. PROBLEM RESOLUTION

TekAide technicians aim to resolve all repair, installation, upgrade, and other service issues and problems with reasonable effort. Should the service problem prove to be more difficult than anticipated or with no possible cost-effective remedy or solution, SESTIGE SOLUTIONS reserves the right to declare the situation unserviceable and end the service call with a cancellation and refund of the charges associated with the service call.

14. SERVICE LIMITATIONS

SESTIGE SOLUTIONS TekAide services do not include user training, programming, or development support on the hardware systems or software programs repaired, installed, or upgraded.

SESTIGE SOLUTIONS’ access to proprietary information from vendors and manufacturers is limited. Should proprietary information be essential to the service call, TekAide technicians will advise Client regarding the appropriate course of action.

SESTIGE SOLUTIONS reserves the right to refuse to perform a service call that is outside the scope of the services as defined in this Service Contract. SESTIGE SOLUTIONS will advise Client of service limitations during the diagnosis call for a service appointment.

15. SERVICE CONTRACT REVISIONS AND UPDATES

SESTIGE SOLUTIONS will take reasonable effort to advise Clients of revisions and updates to this Service Contract. Revisions and updates will be posted on www.sestige.com for Clients to review. Use of the TekAide service constitutes acceptance of the Service Contract and any revisions or updates posted.

16. PRIVACY

SESTIGE SOLUTIONS is bound by its privacy policies. Should TekAide technicians require knowledge of password or personal access information from Client related to the service call, SESTIGE SOLUTIONS recommends that Client should promptly reset such password and personal access information after the service call.

17. DISCLAIMER OF WARRANTIES

Your purchase of the TekAide service, use of the SESTIGE SOLUTIONS Web site, and access to any information related to both, are at your own risk.

Unless otherwise stated in this Service Contract, SESTIGE SOLUTIONS makes no warranty that TekAide Services or the SESTIGE SOLUTION Web site will meet your requirements and expectations, or be uninterrupted, error-free, timely, secure, accurate, reliable, or free of viruses and malware code.

Except otherwise stated in this Service Contract, TekAide services and the SESTIGE SOLUTIONS Web site are provided as is and as available.

18. LIMITATION OF LIABILITY

SESTIGE SOLUTIONS and TekAide technicians shall not be responsible for lost, altered, or corrupted software, data, or files as a result of the service call. Client assumes responsibility for backing up all software, applications, programs, data, files and other essential information prior to the service call.

19. CHOICE OF LAW AND JURISDICTION

This Service Contract and your relationship with SESTIGE SOLUTIONS will be governed by the laws of the state of New Jersey, with personal and exclusive jurisdiction of the courts located within Monmouth County. Any dispute arising from your use of the services provided by SESTIGE SOLUTIONS must be brought exclusively to the courts of Monmouth County, New Jersey.



20. TRADEMARK INFORMATION

SESTIGE SOLUTIONS, the SESTIGE SOLUTIONS logo and all other SESTIGE SOLUTIONS marks contained herein are trademarks of SESTIGE SOLUTIONS. All other trademarks are the property of their respective owners.
